New WHS Laws Require an Asbestos Register and Management Plan

New Workplace Health and Safety Laws from 31 March 2022 in Western Australia

The new Work Health and Safety Act 2020 (WHS Act) and Work Health and Safety (General) Regulation 2022, imposes duties, responsibilities and obligations upon persons in management or control of a workplace.

All properties now require an Asbestos Register where any work is conducted.

Key things to note:

  • Irrespective of build date, a person with management or control of a workplace must ensure, so far as is reasonably practicable, that all asbestos or asbestos containing material (ACM) is identified by a competent person unless it is assumed that asbestos is present.
  • Regulations 425 and 429 require an Asbestos Register and Management Plan to be at each property
  • Registers and Inspections continue to be required however the WHS Regulations require that an asbestos register is required for all buildings whenever constructed, except for buildings constructed after 31 December 2003 if no asbestos or ACM has been identified and none is likely to be present from time to time.
  • New regulations (part 8.8 r475) state the air monitoring is required for a Class A (friable asbestos) removal.
  • New WHS regulations require new matters to be included in Asbestos Management Plans, including procedures for incidents and emergencies, and the workers carrying out work involving asbestos.
